Acceptance of the Terms

By accessing or using the Café em Dia platform and the Jorge assistant ("Platform"), offered by CAFE EM DIA TECNOLOGIA LTDA ("Café em Dia"), you ("User" or "Licensee") fully agree to these Terms of Use. If you do not agree with any provision set out here, do not use the Platform.

Continued use after changes to the Terms implies acceptance of the new conditions. Notices about relevant changes will be sent to the registered e-mail at least 15 (fifteen) days in advance.

Description of the Service

Café em Dia is a coffee farm management platform with an artificial intelligence assistant, Jorge. The Platform offers:

A conversational AI assistant for queries and guidance on farm operations
Recording and control of crops, workers, harvests, inventory and cash
Conversation and session history per user
A dashboard for viewing and managing farm data
Optional integration through WhatsApp
The Café em Dia app in ChatGPT, to record and query farm data through the conversation in ChatGPT

Café em Dia is a data control and organization tool. We are not a financial institution, we do not carry out financial transactions, we do not operate bank accounts and we are not affiliated with any regulated financial entity. The financial records available on the Platform serve exclusively management and internal control purposes.

Nature of the Artificial Intelligence

The Jorge assistant is powered by artificial intelligence language models. The User acknowledges and agrees that:

AI can make mistakes. The responses generated are based on probabilistic models and may contain inaccuracies, omissions or outdated information.

Jorge does not replace professional advice. The guidance provided by the assistant is not equivalent to agronomic, legal, accounting, financial or any other regulated professional consulting.

Responsibility for decisions lies with the User. Any administrative, operational, agronomic or commercial decisions made based on the information or suggestions provided by the Platform are the User's sole responsibility.

No guarantee of results. Café em Dia does not guarantee that the guidance generated by the assistant will produce the results the User expects.

Registration and Access

4.1.

Access to the Platform requires registration with a valid e-mail and phone number, and authentication by e-mail and password or by a one-time code (OTP) sent to the e-mail provided.

4.2.

The User is responsible for the confidentiality of their access credentials. Sharing login and password is prohibited and may result in suspension of the account.

4.3.

The User must keep their registration data up to date. Incorrect or outdated information is the User's sole responsibility.

4.4.

Each account is linked to one farm. Access to data is isolated per farm and controlled by permissions defined by the account administrator.

4.5.

Subscribing and holding the account of a farm require legal capacity (18 years of age or emancipation).

Café em Dia App in ChatGPT

5.1.

The Café em Dia app in ChatGPT is a channel of access to the same account and the same data of the Platform. To use it, the User connects the app in ChatGPT and signs in with their Café em Dia account, on the Café em Dia screen. Permissions are the same as in the dashboard: someone who can only view a farm cannot write data through this channel.

5.2.

ChatGPT is a service of OpenAI, governed by OpenAI's terms and privacy policy. Café em Dia is not made, maintained or endorsed by OpenAI and is not responsible for the availability of ChatGPT or for how it interprets the User's requests.

5.3.

The app records and queries harvest, cash, worker payments, input inventory, field operations, plots and workers. The other features remain in the dashboard, and the app points to the right page.

5.4.

The User may disconnect the app at any time in the ChatGPT app settings. Disconnecting does not delete the account or the data; to delete them, see section 11.

Free Period through ChatGPT

6.1.

A farm created from the app in ChatGPT, without a subscription, has a free-use period of 14 (fourteen) days, counted from the first record made on the farm (and not from sign-up).

6.2.

During the free period, the User records and queries, through ChatGPT and the dashboard, harvest, cash, inventory, field operations, crops, workers and payments. Jorge on WhatsApp, document reading, access for other team members and the remaining areas of the dashboard are reserved for the subscription.

6.3.

The free period generates no charge, does not ask for a card or any payment data and does not convert into a subscription automatically.

6.4.

When the free period ends, the account remains available for viewing only: data can be seen but not changed. If the User does not subscribe, the account, the farm and its data are deleted 12 (twelve) months after the end of the free period, with e-mail notice at least 30 (thirty) days beforehand, in accordance with the Privacy Policy.

6.5.

The free period applies once per farm; registering again does not restart it.

Subscription, Payments and Cancellation

7.1.

Full access to the Platform depends on taking out a subscription. The price depends on the farm's coffee area in production, as informed by the User, and is presented before payment. The subscription may be monthly or annual.

7.2.

The subscription is taken out in the Café em Dia dashboard, on the website, or with our team. The app in ChatGPT does not sell the subscription or initiate payments.

7.3.

Payments are processed by third parties (currently Asaas) and are subject to the terms and policies of those providers.

7.4.

Café em Dia does not store credit card data or payment instruments. This information is held exclusively by the payment processor.

7.5.

Cancellation may be made at any time by the User. Access remains active until the end of the period already paid.

7.6.

There is no pro rata refund for unused periods, except as otherwise required by law or expressly agreed.

User Obligations

The User undertakes to:

Use the Platform exclusively for lawful purposes related to the management of their agricultural activity

Enter true, accurate and up-to-date information

Hold lawfully the data of workers and third parties that they record on the Platform

Not use the Platform to store, transmit or process illegal or offensive content or content that violates third-party rights

Not attempt to circumvent authentication or security systems or usage limitations

Not reverse engineer, decompile or modify any component of the Platform

Notify immediately in case of suspected unauthorized access to their account

Availability and Maintenance

9.1.

Café em Dia uses its best efforts to keep the Platform available, but does not guarantee continuous, uninterrupted or error-free availability.

9.2.

Interruptions may occur due to scheduled maintenance, infrastructure failures, unavailability of third-party services (artificial intelligence providers, ChatGPT, WhatsApp, database, cloud providers) or events beyond Café em Dia's control.

9.3.

Café em Dia is not liable for losses arising from temporary unavailability of the Platform.

Limitation of Liability

10.1.

Café em Dia will not be liable for:

Administrative, operational, agronomic or commercial decisions made based on information provided by the Platform or by the AI assistant

Indirect, incidental, consequential or punitive damages or loss of profits

Data loss caused by the User's action or omission

Failures in third-party services integrated with the Platform

Unauthorized access resulting from the User's negligence in safeguarding their credentials

Use of the Platform in environments or situations where failures may cause physical, personal or environmental harm

10.2.

Where applicable, Café em Dia's total liability is limited to the amount actually paid by the User in the 12 (twelve) months preceding the event giving rise to the damage.

Suspension and Termination

11.1.

Café em Dia may suspend or terminate the User's access in case of:

Violation of these Terms
Fraudulent or abusive use of the Platform
Confirmed default after notice
Legal or court order

11.2.

The User may close their account at any time, in the dashboard (Settings → Delete my account) or by request to support. After closure, data will be retained or deleted as described in the Privacy Policy.

Intellectual Property

12.1.

All rights in the Platform, including software, prompts, brand, visual identity, methodology and documentation, belong exclusively to Café em Dia.

12.2.

Data entered by the User remains the User's property. Café em Dia does not claim ownership of the User's farm data.

12.3.

The license of use granted to the User is personal, non-transferable, non-exclusive and revocable, valid while the contractual relationship is in force.

Changes to the Platform

Café em Dia reserves the right to modify, suspend or discontinue features of the Platform at any time, with or without prior notice, without this giving rise to any right to compensation.

Governing Law and Venue

These Terms are governed by Brazilian law. The courts of the judicial district of Alpinópolis/MG are chosen to settle any disputes, waiving any other, however privileged.
